Employment Based Immigration Third Preference (EB-3)
The EB-3 visa is a U.S. employment-based permanent resident visa designed for foreign workers whose skills are essential to the American economy or when employers cannot find qualified candidates locally. To apply under the EB-3 category, applicants must have a sponsorship from a U.S.-based employer and complete the PERM labor certification process before filing for a green card.
While many individuals work temporarily in the U.S. on nonimmigrant visas, some seek to establish permanent residence. The EB-3 green card allows foreign nationals to live and work legally in the United States for up to 10 years per issuance. It is a popular green card option due to its relatively accessible requirements, although this popularity can lead to longer processing times.
The program has been broadly categorized in three streams
The EB-3 visa is classified as a Third Preference (Priority) Worker visa that enables three categories of workers to live and work permanently in the United States. These eligible worker groups include:
Skilled Workers
Those who have completed at least 2 years of job experience or training.
Professionals
Those who can prove that they have a higher educational degree or its equivalent such as a Bachelor’s Degree.
Unskilled Workers
Those who have less than 2 years of work experience or training. Unskilled workers get the EB-3 visa as explained in the article.
Note: The EB-3 visa has an annual cap on the number of visas granted. Out of the total 140,000 employment-based immigrant visas issued each year, approximately 28.6% (around 40,040 visas) are reserved for the EB-3 category. Once this quota is filled, additional applications are deferred and processed in the following year.
Benefits of the EB-3 Visa?
With an EB-3 visa, foreign workers can live and work permanently in the United States without needing a separate Employment Authorization Document (EAD). After maintaining the same job for a few years, they have the flexibility to change employers or job positions. EB-3 visa holders receive a green card and must comply with all applicable tax obligations. They are free to travel both within and outside the U.S., and can reside in any state, not just where they initially settled. Additionally, the EB-3 visa allows spouses and dependent children to accompany the primary applicant and obtain their own U.S. green cards.
